Federal appeals court hears arguments over Dakota Access pipeline

Preskey noted the work was taking place outside of a temporary no-construction zone that extends 20 miles east and west of Lake Oahe, as ordered by a federal appeals court considering the Standing Rock Sioux Tribe's request for an injunction to halt the pipeline.

"The U.S. Army Corps of Engineers approved the pipeline without consulting with our tribe".

Authorities have arrested 95 people in connection with the pipeline protests since they began in mid-August.

A federal appeals court is scheduled Wednesday to hear a tribe's request for an injunction to halt construction on an oil pipeline in North Dakota.

In September, they ordered the group of firms building the pipeline, led by Energy Transfer Partners LP, to pause construction on the disputed section of the route while they consider the tribes' request that the US government withdraw permits for the project.

"We urge you to adhere to the well-established regulatory process for permitting private infrastructure projects and approve the easement for the remaining section of the Dakota Access project without delay", they continue.

Jan Hasselman, the attorney for the Standing Rock Sioux, told reporters outside the courthouse after the hearing that the appeal "should take three or four months" to resolve.

The judges are not expected to rule for months.

Jon Eagle Sr., a tribal historic preservation officer for the Standing Rock Sioux Tribe, will be allowed to survey an area of the pipeline corridor that hasn't been disturbed by construction, Preskey said. This pipeline has already destroyed the burial places of our Lakota and Dakota ancestors.

Five labor unions with almost 3.5 million members have written to President Barack Obama to urge that the Dakota Access Pipeline construction proceed, Kallanish Energy is reporting.

The Standing Rock Sioux Tribe has every right to protect their land, their water, their cultural resources and their ancestral graves, according to Pipestem. "The approval of this pipeline by the U.S. Army Corps of Engineers is a violation of our treaty rights and we will not stop fighting until our lands, people, water and sacred places are permanently protected", Archambault added.
