Oversight Votes to Hold Hillary's IT Aide in Contempt

When Pagliano didn't show, Republicans immediately adjourned the hearing and held a business meeting to vote on the contempt of Congress resolution.

A lawyer for the aide, Bryan Pagliano, said his client was defending his right not to appear because the committee was informed ahead of time Pagliano will assert his Fifth Amendment rights at the hearing and the only objective otherwise for his appearance, according to the ranking Democrat on the committee, is a Republican "photo-op". He said the committee was "left with no choice" when Pagliano skipped again.

The House Oversight and Government Reform Committee had been trying unsuccessfully to obtain testimony from Bryan Pagliano, who has been one of the key figures in the email controversy that continues to dog Clinton in the home stretch of the presidential election. "This committee can not operate, it can not perform its duty ... if subpoenas are ignored".

Republicans say the subpoena was issued correctly and transparently, and that Pagliano has no reason not to testify. Pagliano, a former information resource management adviser at the State Department, is scheduled to appear Tuesday before the Oversight and Government Reform Committee.

But Rep. Elijah Cummings, D-Maryland, vigorously defended Pagliano's decision not to show up, saying that the committee had harassed him by sending US marshals to his workplace with the subpoena.

Cummings has continuously charged that the hearings related to Clinton's email server are political in nature.

Pagliano is believed to know better than most how the server was set up and maintained and what may have happened to emails that were deleted from the system, including after it was publicly revealed that Clinton was using a private server. Mr. Pagliano was expected to testify regarding the circumstances that resulted in a failure to preserve federal records belonging to the State Department. He spoke previously to the FBI under immunity, telling the bureau there were no successful security breaches of the server.

"We can not make this government work - we can not function - if people will not adhere to the Constitution, the rules and the basic ability of the Congress to talk to these people", Mica said. His lawyers said at the time that Pagliano did not want to relinquish his rights under the U.S. Constitution's Fifth Amendment against self-incrimination.

"It's destroying the reputation of this committee", said Del.

Combetta, along with two others who had worked on the Clinton server, also refused to testify last week before Chaffetz' committee, but they did show up for a hearing. Chaffetz noted he has questions that fall outside the purview of the Benghazi panel.

Chaffetz issued subpoenas on September 9 to Pagliano and Platte Rivers Network employees Paul Combetta and Bill Thornton, who both pleaded the Fifth Amendment.
