Judge Faces Inquiry For Controversial Remarks In Rape Case

But perhaps the most egregious abuse of the alleged victim came as Camp was questioning her about the assault. Per court records from the trial, Camp also questioned why she didn't do more to prevent the attack, such as "skew her pelvis" or to avoid penetration, push her bottom into the sink. He openly wondered, "Why couldn't you just keep your knees together?".
At the time, Camp chose to rule against the young woman and the accused, one Alexander Wagar was acquitted.
The verdict was overturned on appeal. A second trial for Wagar is scheduled for November 2016. According to the allegations on the Council's website, the statements from Robin Camp in the rape case are not only misguided but also alarming.
An investigation into his comments was launched after four law professors filed a complaint against him and members of the public quickly followed suit.
Slate reports that Canadian Judicial Council is now debating whether to oust Justice Robin Camp, and will make their decision after closing arguments on Monday.
Camp, who is from South Africa, also acknowledged his lack of knowledge about Canadian criminal law. But his legal-aid practice focused mostly on contractual, bankruptcy and trust law, as well as oil and gas litigation. Ignorance of the law is not an excuse for criminal behavior - in fact, this is clearly explained by Canadian criminal law Section 19.
"My colleagues knew my knowledge of Canadian law was very minimal".
Which is beyond disgusting anyway, but especially because Camp's comments don't suggest he didn't think the victim was raped, but that he thinks she didn't do enough to "protect" herself, so the rapist shouldn't be convicted of rape.
Now, she worries that other rape survivors will read Camp's comments and stay silent about what happened to them.
"I recognize that I'd made a number of vulnerable people miserable".
And while conceding that her father could be "a bit old-fashioned" in his thinking, she claimed that he is not a sexist. Due to the case, Justice Robin Camp is facing a hearing to save his career.
"He made me hate myself and he made me feel like I should have done something. that I was some kind of slut", the woman told the hearing earlier this week.
But the damage to a young girl who was the target of Camp's words has been done.
"The thing I feel worst about is the questions I asked of the accused, " he said yesterday before correcting himself and saying: "The complainant".
Despite issuing an apology on Friday, September 9, his fate still lays in the hands of the Canadian Judicial Council, who are now conducting an investigation into the matter, which occurred in 2014. As of this writing, there is no timetable for when the matter will be settled once and for all.
