India Delhi bus gang rapists lose death row plea

It said in a review petition the petitioner can not be allowed to re-argue merits of the case by pointing out certain evidences and materials, which were on the record and were already looked into by the trial court, HC and this court as well.

A bench comprising Chief Justice Dipak Misra and justices R Banumathi and Ashok Bhushan today rejected the pleas of Mukesh (29), Pawan Gupta (22) and Vinay Sharma (23), seeking a review of the top court's verdict upholding the death sentence awarded to them, saying no grounds were made out for a review of the judgment.

The bench also ruled that the three convicts were heard elaborately during the stage of their appeal against the Delhi High Court's judgement, and no case had been made out by them for review of the apex court's verdict upholding the death penalty. Three then appealed to the Supreme Court to have the death sentences converted to life imprisonment. If that fails, their last legal option is to file a mercy plea before the President. His lawyer had claimed that his client was being framed.

The woman was raped on the intervening night of December 16-17, 2012 in a running bus in south Delhi by six persons.

Singh was dumped on the streets 45 minutes later with horrific internal injuries, and died 13 days later in a Singapore hospital. The incident had triggered a massive anger among the people that led to the government to adopt several laws for the safety of women.

The apex court during the hearing of the case on Monday said that the death row convicts failed to point out "error apparent on the face of record" in the judgement.

In its 2017 verdict, the Supreme Court had upheld the death sentence the Delhi High Court and trial court had awarded to the convicts for raping the 23-year-old in a moving bus in December 2012.

In the years since, women's advocates say that the Nirbhaya case raised awareness, prompting more women to come forward if they're abused or assaulted, with authorities responding to the concerns with more closed-circuit security cameras and fast track courts for crimes against women.

"The review petition of all the three convicts has been rejected", A. P. Singh, a lawyer for the defendants, told reporters.

The attack shocked the nation and sparked widespread protests. The fifth convict committed suicide in jail in 2013 while the sixth one was a minor at the time. On July 9, 2018 SC will decide the fate of the four accused of death sentence in the Nirbhaya gang-rape case.
