Trump Just Announced Plans to Rescind Obama-Era Guidelines on Affirmative Action

The following year, the Bush administration advised schools to use "race-neutral methods" to determine where children go to school, suggesting that officials use socioeconomic status instead of race. I think many non-conservatives who may have sympathy for the use of affirmative action are growing increasingly uncomfortable with the fact that Asian Americans are being discriminated against in addition to whites.

The decision, which is expected to be made on Tuesday, according to two sources familiar with the plans, would reverse efforts by former President Barack Obama's administration to increase diversity in schools through affirmative action, The Wall Street Journal reported.

The 2011 guidance sought to help school districts thread the needle when using race or other factors in enrollment policies. "This most recent decision by the Department of Education is wholly consistent with the administration's unwavering hostility towards diversity in our schools", Clarke said.

The Trump administration "could just be rescinding the Obama-era polices", Ilya Shapiro, a senior fellow at the Cato Institute, told Fox News.

"The Supreme Court has determined what affirmative action policies are Constitutional, and the Court's written decisions are the best guide for navigating this complex issue", DeVos said in a statement.

The move comes as the Justice Department is investigating whether Harvard University is illegally discriminating against Asian-American students by holding them to a higher standard in its admissions process.

The case is likely to go to trial this fall and may ultimately be decided years from now by the US Supreme Court.

The new Trump policies are "good news", Clegg told Breitbart News in an interview June 3.

The Justice Department in the Trump administration had already signaled its concern about the use of race in admissions decisions. He noted that administrative guidance does not carry the legal weight of court rulings or statutes enacted by Congress. The Supreme Court has upheld race-conscious admission practices as recently as 2016, but affirmative action in higher education remains a contentious issue. They were talking about when schools and colleges and universities want to try and promote diversity amongst their student body and how they are able to do that. "We still have all of the Supreme Court rulings that would influence how we handle this". In a statement, the school called the lawsuit an attack on its ability to consider race in admissions, which it says is necessary to assemble a diverse mix of students.

The Obama and Trump administrations fundamentally disagree on how to interpret Supreme Court precedents and the value of diversity and whether it should be encouraged through race-conscious policies or if it is a sign of intentional racial discrimination, she said.

As Peter Wood said at the time, the guidance documents "seem to sanction common university practices which circumvent the law".

The Justice investigation has also drawn a strong rebuke from numerous organizations representing minority groups, which argue that this is a step toward doing away with affirmative action altogether.
