Apple seeks $1bn from Samsung after patent infringement dispute

"Do you remember what cell phones looked like in 2006?"

"Lawsuits can take a long time", Lee told jurors Tuesday. "Samsung recognized they had a crisis of design and in 4 months- 4 months-came up with the infringing phones".

Apple also included 2 utility patents covering its bounce-back scrolling and pinch-to-zoom features. The jury is considering all the facts and thinking about what amount Samsung should pay for all the damages that it has caused to Apple.

Apple and Samsung are now fighting it out again. Apple has disputed that while it's a much of money, "Samsung violated millions and millions and millions of times". Apple originally sought $2.75 billion in damages.

In the present case, Samsung was discovered liable of encroaching three outline patents. He also argued that the phone industry as a whole was moving toward screen-focused phones in 2007, and that the iPhone was not the first or only phone with a prominent screen design.

The phone is described as having two cameras, one on the front left that works in phone mode and the other at the top right so when in tablet mode they can be used like a dual camera.

"What was Samsung's solution?" he asked the jury rhetorically. The design patents that Samsung infringed concern the physical shape that would become the iPhone, the bezel, and the colorful grid of icons. And the Supreme Court ordered the U.S. Court of Appeals to redetermine the value Samsung owes Apple for the design patent violation, which directs to the trial that's happening this week. The Patent Act awards all profits from sales of any "article of manufacture" that infringes a patented design. "They're seeking profits on the entire phone", explained Samsung lawyer John Quinn. Judge Lucy Koh, who presided over a previous retrial, instituted a "Groundhog Day" rule, according to the BBC, meaning that no new evidence can be introduced, and the jury must not re-adjudicate the initial verdict that Samsung was found to have infringed on Apple's patents. The glass is easily separated from the phone and doesn't cost much, Samsung has argued.

"Design is what ties it all together", Lee said in US Northern California District Court in San Jose, California.

In late 2016, the US Supreme Court made the ruling in favor of Samsung's side in a unanimous decision. However, after a 2013 retrial and other appeals, the financial damages were reduced, Bloomberg reported.
