The messaging service will now ask users in the 28 European Union states to confirm that they are aged 16 or older as part of a prompt when they are asked to accept the new terms of service and updated privacy policy.

With just one month until the new EU General Data Protection Regulation Legislation (GDPR) comes into force, data security company WinMagic, has today released the findings of research that suggests many companies will not be ready when it takes effect on May 25th, 2018. Rather than banning them outright, the social media platform will require anyone between the ages of 13-15 to get permission from a parent or guardian. It's not quite clear how WhatsApp plans to enforce its 16-or-over rule.

At present, WhatsApp does not ask users their age when they join, nor does it cross-reference their Facebook or Instagram accounts to find out.

The new laws also give regulators the power to fine corporations up to 4 per cent of their global turnover or €20 million, whichever is larger, for failing to meet the tough new data protection requirements.

Under the law, children must be 16 years of age in order to give consent for their personal data to be processed.

The sudden change of strategy may have come along the heels of the fact that recently, WhatsApp has come under the scanner across Europe for its end-to-end encoded messaging system and its tactic to share more information with its parent organization, Facebook. Twitter is also giving users more control over how it shares certain non-public data. This feature, Request Account Info, will be rolling out to all users around the world on the newest version of the app. The CONSENT act provides further protection for consumers by prohibiting edge providers from refusing to serve users who do not consent to the use and sharing of their information.
