United States cop charged with murder of Australian woman bailed

The 40-year-old had moved to the United States to marry her fiancee whose name she had already legally adopted.

March 21 -- Noor makes first appearance in court.

But he added: "Clearly Officer Noor violated the rules and deserves to be charged".

The penalty for third-degree murder is up to 25 years in prison and second-degree manslaughter carries a penalty of up to 10 years, according to a state website. The murder charge is for a death caused without intent.

Bond was initially set at $500,000, jail records show.

Bryant believes the question of whether or not Noor will potentially take the stand in this case depends upon the defense.

Damond's family said in a written statement that they're pleased that Hennepin County Attorney Mike Freeman chose to bring charges.

Noor, who had been on paid leave since the shooting, was sacked from the police force Tuesday.

Noor's attorney's says he should not face charges because he acted the way he was supposed to.

"No charges can bring our Justine back", the statement read. Noor and his fellow officer Matthew Harrity arrived at the scene and were sitting in their police auto when Damond approached them.

Plunkett has said that Noor extended his "thoughts and wishes" to Damond's family and raised concerns about Freeman's objectivity. She died from a gunshot wound to the stomach. State investigators say the officers involved in the shooting had not turned on their body cameras and squad vehicle video didn't capture the shooting. He says Noor "recklessly" fired his weapon, without fully investigating the situation.

Officer Mohamed Noor turned himself in on Tuesday after a warrant was issued for his arrest in the death of Justine Ruszczyk (ROOS'-chehk) Damond. Alleging that Freeman "routinely fails to hold police officers accountable", Levy-Pounds said it should not have taken the death of "a attractive white woman" for Minneapolis residents to "wake up".

Minneapolis Police Chief Janee Harteau lost her job in the aftermath of Ms Damond's death and in November Mayor Betsy Hodges became only the second Minneapolis mayor in 40 years to run for a second term and lose.

While Noor has declined to give a statement, Harrity later said that before the shooting he and Noor had cleared the call and were at the end of the alley waiting for a bicyclist to pass. Harrity had replaced the safety hood on his holster, and Noor had cleared the call on the computer.

"We remain hopeful that a strong case will be presented by the prosecutor, backed by verified and detailed forensic evidence, and that this will lead to a conviction", said the statement released through family attorney Robert Bennett.

In detailing the charges against Noor, Freeman emphasized the extensive training the officer and his partner received in handling high-stress situations and making life and death decisions. Freeman apologized just a few days later, saying he shouldn't have discussed the case in detail in public. He then convened a grand jury to help him investigate the case because, he said, several officers weren't cooperating.

Freeman maintained Tuesday that the decision to charge Noor was his.
