O'Reilly Accuser Sues Because Bill Keeps Talking About Her

A woman who settled a sexual harassment complaint against former Fox News host Bill O'Reilly alleges in a new suit that he and the network breached their nondisparagement and confidentiality agreements after she was outed in a New York Timesstory about claims against O'Reilly.
"O'Reilly portrayed himself as a "target" and claimed that complaints against him are extortionate", Ms. Bernstein's lawsuit said. In October, The Times reported that Fox News legal analyst Lis Wiehl settled for $32 million.
O'Reilly has denied any wrongdoing. According to Bernstein's lawsuit, there was no hotline at the time, and she in fact told others at the network about the mistreatment.
Bernstein is also suing the defendants for breach of the covenant of good faith and fair dealing, as well as targeting O'Reilly for allegedly tortiously interfering with Bernstein's settlement agreement with Fox News.
In a statement, Rachel Witlieb Bernstein's lawyer said since O'Reilly's history of alleged sexual harassment has become public, Bernstein has experienced "widespread distribution of disparaging, defamatory, and false claims against her".
"Knowing Ms. Bernstein and O'Reilly's other victims are afraid to speak out because he and Fox forced them to sign non-disclosure agreements, O'Reilly and Fox have made false and disparaging claims", the statement said.
"O'Reilly portrayed himself as a "target" and claimed that complaints against him are extortionate", the lawsuit filed Monday in the U.S. District Court for the Southern District of NY said, according to The Times.
"In fact, Mr. O'Reilly is the liar", according to the lawsuit, which was filed in federal district court in Manhattan.
"Mr. O'Reilly is the liar".
The amount of the payout was not disclosed, though the story notes that the network paid five women about $13 million to forego litigation over O'Reilly's behavior. "The statement by Fox News also violated the Confidentiality Clause in the Agreement".
O'Reilly was sacked on April 19 from Fox News after a 20-year run at the cable network.
The New York Times reported in April that Bernstein left the network after filing a complaint about him "storming into the newsroom" and yelling at her.
"O'Reilly has repeatedly said that the harassment allegations that led to his ouster from Fox News in April have no merit, that he never mistreated anyone and that he resolved the matters privately to protect his children".
The plaintiff said she was not the source for the information printed in the Times story.
