Cosby defense rests without calling the comedian to testify

The case could reach the jury early this week.

The big question going into Monday's proceedings was whether Cosby would testify - a high-stakes gamble that could have allowed him to work his charm on the jury but could have also exposed him to blistering cross-examination about some of the scores of other women who say they were assaulted by the comic once known as America's Dad. He had the hard task of stemming the momentum built by prosecutors during an intense week of testimony that included an emotional appearance by Andrea Constand, a former Temple University women's basketball staffer who says Cosby drugged and sexually assaulted her in 2004.

Cosby attorneys said they would not call any character witnesses.

On her podcast Kandidly Keshia, the actress shared her her reason for attending Cosby's trial, also adding that the opinions of those online were harsh.

Steele argued that admission showed Cosby was knowingly trying to incapacitate Constand when he gave her 1-1/2 pills, which Cosby said were Benadryl. "The Cosby Show" star is charged with three counts of aggravated indecent assault for allegedly drugging and molesting former Temple University employee Andrea Constand in January 2004 at his mansion in Elkins Park, Pennsylvania.

This is the first time Cosby's wife has been seen at the courthouse since the 79-year-old comedian's criminal trial began last week.

Judge Steven O'Neill asked Cosby a series of questions created to make sure he was aware of his right to testify and wasn't pressured into deciding against it.

The light moments include: Constand's brother-in-law struggling to remember the year he got married but instantly knowing the day he joined the Toronto police force; her mother testifying that she had been truthful in telling Cosby - who thought he was being recorded - that she has a parrot and telling the court his name is "Ozzie"; and Judge Steven O'Neill bringing in an oversized gavel and promising to use it if things get rowdy after jurors asked why he didn't have one. A lawyer on the case recalled her startling account of being drugged and sexually assaulted by Cosby, but his notes revealed a glaring discrepancy in the account. Jurors have heard Cosby's version of the events in question in the form of his police statement, and his lurid deposition in her 2005 lawsuit.

In 2015, Steele cited the Cosby deposition as new evidence in reopening the long-abandoned case against Cosby stemming from the Constand accusation.

Cosby said last month that he would not be taking the stand during the trial, though his publicist, Andrew Wyatt, implied while speaking to the press during a court break last week that it is a possibility. At the time, she was director of operations for the women's basketball team at Cosby's alma mater, Temple University. The combination of vulnerability and defiance made her the strongest arrow in the prosecution's quiver.

Constand said that she was "mistaken" when she made those statements to police. And she was one of a handful of accusers who hadn't told her story fully in a written piece or TV segment. Cosby has pleaded not guilty.

And the language he uses to describe his sexual encounters with various young women can be jarring.

Bill Cosby did not take the stand Monday, and his defense closed their case after only six minutes, with testimony from one person, Detective Richard Schaffer.

In his 2005 deposition, Cosby said he obtained several prescriptions for quaaludes in the 1970s and offered the now-banned sedatives to women he wanted to have sex with.

Dozens of women have come forward to say he had drugged and assaulted them.
