Democrats say adoption bill is discriminatory

Its author, Rep. James Frank, says it's created to keep faith-based organizations offering adoption services by shielding them from potential lawsuits. "When children are removed from their families because of neglect or abuse, the State has an obligation to place them in homes based on the children's needs and the prospective family's ability to meet those needs, not on the religious beliefs of the agency hired by the State to find them homes".

"In addition, this discriminatory bill purports to "solve" this issue of those children and prospective parents denied placement and participation for so-called religious reasons through the creation of a separate foster care system". Rep. James Frank of Wichita Falls said that his measure directs child services to ensure that other outside adoption providers without religious objections will be available to potential adoptive parents who were turned away by those who raise objections.

Such actions include denying funding, canceling contracts, and declining licensure, for example. Midnight Thursday is the deadline for the House to pass bills that originate in that chamber, meaning hundreds of pieces of legislation will all but die if not approved by then.

Gay rights groups and some foster families worry they're being unfairly targeted by a state adoption bill passed Wednesday by Texas House lawmakers.
